05Terms of service
These terms govern use of the Daylighting service and the application supplied with it, between you and Kairoi Co. OÜ. Using the service means accepting them.

We compute daylight and sunlight quantities to BRE 209 (2022) and EN 17037 from geometry you supply, and print them with their workings. The output goes out under your name, not ours. The professional opinion in it is yours, because the calculation is not an opinion.
Software that computes the BRE 209 tests — vertical sky component, daylight factor, no-sky line, annual and winter probable sunlight hours, garden amenity and overshadowing — on real building geometry, and prints the results with the inputs that produced them.
It is a calculation service and a document generator. It is not a consultancy, and using it does not make us a party to your project.
The service is offered to businesses and professional practices. It is not a consumer service, and the statutory fourteen-day withdrawal period for consumers does not apply. If you are contracting on behalf of a practice, you confirm you are entitled to do so.
This is a white-label service, and the licence to brand the output is part of what you are buying rather than a concession we make. Accordingly:
The relationship is confidential in both directions, permanently and without either of us having to ask.
Nothing here prevents you from answering honestly when a regulator, an insurer, a court or a professional body asks you a direct question about how your work was produced. This clause is about marketing and disclosure, never about candour to an authority.
We print the number and we print the threshold beside it. We do not sign a professional opinion, and the report is not one.
Because the output carries your name, the professional responsibility for it is yours: for deciding that the method suits the scheme, for the inputs, for interpreting the results, and for whatever advice you give on them. You are responsible for holding the professional qualifications, registrations and insurance your own regulator requires. We are your calculation supplier, not your co-author and not your insurer.
Each input is marked with how it was obtained — declared by the owner, taken from a survey footprint, derived from imagery, or typed in by hand — and that mark travels with the value into every view and onto the printed page. It cannot be detached from the number it describes.
This is deliberate. A report whose sources cannot be read is a report that cannot be defended. Where you choose a lower grade of source, you are choosing it knowingly, and the report says so on its face.
You may override any input. When you do, the value is marked as hand-typed, the engine's original is kept beside it, and one click puts it back. An override never inherits the standing of the value it replaced, and a typed number cannot be made to look like a surveyed one.
The calculation is deterministic and uses no AI: nothing is guessed, sampled or generated by a model. The same inputs on the same engine version produce the same numbers, always, and both are printed on the report. A report can be re-run years later at appeal and will agree with itself.
This is a property of the mathematics rather than a promise about our servers, and it is why the engine version is on the page.
Each report comes with the file that made it — the scene, the answers and your corrections, hashed and signed. Holding that file is what lets you produce the report again at any time, including years later at an appeal.
Reports, their files, revisions and project records live on your computer. We do not retain them and cannot produce one for you later: no copy or backup of ours exists to bring them back. Keeping them safe, and backing them up, is your responsibility. If a file is lost, the ledger can still prove what you issued and when, but it cannot rebuild the report.
Where purchased survey data informs a report, we license it and you receive the measurements in the report. You do not receive the supplier's model, which is licensed to us and not sub-licensed to you.
Where accurate data is not available for a site, we tell you which options exist and you choose. We do not silently substitute a lesser source for a better one, and the tier marking in §6 is how you can check that for yourself.
Do not attempt to extract, reverse engineer or reconstruct the calculation methods behind the service; do not resell access to the service itself as a competing calculation service; do not submit geometry you have no right to use. Selling reports to your own clients is exactly what the service is for and is not resale.
Pricing is by enquiry, and volume terms are available. What a run costs you is agreed before you commit and does not change afterwards. Invoices are payable as stated on them. Prices exclude VAT unless the invoice says otherwise. Cancelling, and getting money back, is §13.
Nothing is sold from this website. There is no basket and no checkout here, so there is no order to cancel from a page. Everything begins with a quote you agreed in writing, and that is what a cancellation is about.
Write to enterprise@kairoico.com. We acknowledge within 3 business days, and a refund we have agreed is paid within 14 days, to the account the payment came from, at no cost to you.
These are business-to-business terms. The statutory rights of a consumer, including the fourteen-day right of withdrawal, do not apply to them — see §2.
We do not offer a service-level guarantee. We may change, suspend or withdraw parts of the service, and we will give reasonable notice where a change affects work you have in hand. If we cannot run your job we say so, rather than returning a number we do not stand behind.
We are responsible for our own arithmetic. If the engine computes something incorrectly we will correct it and re-run the affected report at no charge, and that is your primary remedy.
We are not responsible for inputs you supplied or approved, for third-party data you selected, for the professional use you made of the output, or for the outcome of any planning application or proceedings. We are not liable for loss of profit, loss of contract, loss of goodwill or indirect loss. Our total liability arising from a report is limited to the fees you paid us for that report.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Either of us may end the arrangement on written notice. Work already paid for is completed or refunded, and §13 says how. The confidentiality in §4, the licence in §3 for reports already produced, and §15 survive the end of the arrangement.
These terms are governed by the law of Estonia, and the courts of Estonia have jurisdiction. Where you are established elsewhere, this does not deprive you of the protection of mandatory provisions of your own local law.
